TERMS OF USE

1. Parties and Scope

1.1. These Terms of Use ("Terms") govern the legal relationship between ISP TRANSFER VE YAZILIM HIZMETLERI ANONIM SIRKETI (“Company”) and the individual (“User”) using the ISP Driver mobile application (“Application”).
1.2. The application is a corporate tool intended exclusively for professional drivers and relevant roles authorized by the Company under / within the structure of Istanbul Shuttle Port. It is not a publicly available service.
1.3. By downloading, installing, or starting to use the application, you acknowledge that you have read, understood, and accepted these Terms. If you do not agree to these Terms, you must not use the Application and are required to uninstall it from your device.

2.1. In order to use the application, you are required to complete the registration form with accurate and complete information. Once registration is complete, it is mandatory for your account to be approved by the Company.
2.2. Accounts awaiting approval cannot access the Application's basic features until the Company grants approval. The decision to grant or deny approval is at the Company's discretion.
2.3. If your role or authorization at the Company ends for any reason, your account may be suspended or deleted.

3.1. The Company grants the User a personal, non-exclusive, non-transferable, and limited license to use the Application. This license covers the use of the Application solely under these Terms.
3.2.
The following actions are strictly prohibited:
- Copying, modifying, or creating derivative works of the Application or its source code
- Analyzing the Application using reverse engineering methods or attempting to access its source code
- Transferring the Application or this license to third parties or granting a sublicense
- Reselling or distributing the Application for commercial purposes

4.1. You hereby declare that all information you enter into the Application is accurate, up-to-date, and complete. The User is solely responsible for any liability arising from giving incorrect or misleading information.
4.2. You hereby agree not to share your account information, login password, or device access with third parties. If you detect any unauthorized access to your account, you are required to notify the Company immediately.
4.3. You hereby agree to use the Application solely for the operational purposes specified by the Company.
4.4.
Location data:
By using the Application, you consent to the collection and sharing of your location data with the operations team in the following circumstances:
- When you start an active task, your real-time location throughout the task
- When you start a shift, your location history during the shift
If you revoke location permission in your device settings, the Application's basic features may become unavailable.
4.5. You shall not use the Application for any unlawful purposes, in a manner that infringes upon the rights of others, or in a way that damages the Company's systems or compromises its security.

5.1. Navigation and route information provided or directed through the Application — including third-party map and navigation applications (Apple Maps, Google Maps, Waze, Yandex Navi, etc.) — is intended solely for guidance purposes and shall not be considered binding.
5.2. The Company shall not be held liable for any damages resulting from navigation errors, delays in real-time traffic information, incorrect directions, or road conditions. All driving decisions are the driver's responsibility.

6.1.
The Company may suspend or delete your account without prior notice in the following circumstances:
- Violation of these Terms
- Giving incorrect or misleading information
- Misuse of the Application or compromise of system security
- Termination or expiry of the employment contract, service agreement, or authorization
- Decision by a competent authority or legal requirement
6.2. In the event that your account is deleted, your personal data may continue to be processed in accordance with the timeframes and conditions specified in the Privacy Policy. Your legal rights regarding the protection of personal data are reserved.

7.1. Due to technical malfunctions, scheduled maintenance, network outages, or force majeure, the Company does not guarantee that the Application will operate without interruption or error.
7.2. The application is provided "as is" to the fullest extent permitted by applicable law. The Company's liability for indirect, special, or consequential damages is limited to the fullest extent permitted by applicable law.

8.1. The software, design, graphics, text, trademarks, and all other intellectual property rights related to the application belong to the Company and are licensed by the Company.
8.2. Except for the limited usage license granted under these Terms, the User does not acquire any rights to the Company's intellectual property.

9.1. The Company reserves the right to amend these Terms at any time. Important amendments shall be announced via in-app notifications and/or email.
9.2. By continuing to use the Application after the notification of amendments, you agree to the updated Terms.

10.1. These Terms shall be interpreted and enforced in accordance with Turkish Law.
10.2. The courts and enforcement offices of Istanbul Caglayan (Central) shall be competent to settle any disputes arising from or related to these Terms.
